Members of an all-appointed West Virginia Supreme Court of Appeals on Monday will hear arguments in the legal challenges to U.S. Rep. Evan Jenkins' and former House Speaker Tim Armstead's eligibility to serve on that very court. The two petitions challenging Jenkins and Armstead's temporary appointments to the court as well as Jenkins' candidacy for election to the court have been combined into one case that will be on the court’s docket Sept. 24. Chief Justice Margaret Workman and Justice Beth Walker voluntarily disqualified themselves from being involved in the case, according to documents filed in the case. With Workman and Walker out, that left Cabell Circuit Judge Paul Farrell Sr. as the only justice on the court, and he will serve as acting chief justice in the case against Jenkins and Armstead.
