On Wednesday February 4, 2015, at 2:10 pm, Cumberland City Police patrol officer on Frederick Street was waived down by a pedestrian who was identified as Damian Legeer, age 22 of Cumberland. Upon speaking to Legeer, the officer detected an odor of Marihuana emanating from Legeer. When asked if he was in possession of Marihuana, Legeer advised that he had some in his backpack. After further questioning, a probable cause search of the backpack was conducted. As a result, eight individually wrapped baggies containing a total of 237 grams of suspected Marihuana was located. Legeer was also found to be in possession of a quantity of narcotic pills. Legeer was placed in custody and transported to the Cumberland City Police Department for processing. He was taken for a bond hearing at the Allegany County District Court Commissioner’s Office and was released on his personal recognizance pending trial. The street value of the seized Marihuana is estimated at $4,700.00 dollars.

WARRANT SERVICE
On Wednesday February 4, 2015, Cumberland City Police served a Bench Warrant on Michael Caswell, age 28 of Cumberland. The warrant was filed as a result of Caswell failing to appear for court February 3, 2015. Caswell was also served with a Criminal Summons from a Theft incident that occurred on January 21, 2015, at a business on Virginia Avenue. Investigation revealed that Caswell was observed taking stored owned items and left the store without paying for them. Caswell was served and taken directly to the Allegany County Detention Center where he is being held without bail per the issued warrant.

CHARGES: Failure to Appear, Theft less than $100.00 dollars.
ASSAULT
On Wednesday February 4, 2015, at 7:23 pm, Cumberland City Police Officers responded to a private residence in the 500 block of Bedford Street for an Assault. Investigation into this matter revealed that Eric Speller, age 26, assaulted a female victim by throwing her on a couch, put his hands around her neck and briefly choked her. Speller was placed under arrest and was transported to the Cumberland City Police Department for processing. It was also learned that Speller had a Bench Warrant for his arrest for failing to follow conditions of probation for a previous 2nd Degree Assault arrest. After a bond hearing at the Allegany County District Court Commissioner’s Office, Speller was held on a $30,000.00 bond at the Allegany County Detention Center. The victim did not require medical attention.
