Saturday evening, at 10:08 pm, officers from the Cumberland City Police Department responded to 517 Forester Avenue for a repot of a domestic assault.
Upon the officers arrival they made contact with a male victim who was standing in the middle of the street. While officers were speaking with the victim, Jude David Smith exited the residence yelling. Smith yelled at officers that he was pepper sprayed.
While officers were speaking with the victim, he stated that Mr. Smith came home from his friends and started hitting things with an umbrella. Smith was confronted about his behavior at which time he grabbed the victim by his neck. The victim was able to fight Smith off with the aid of pepper spray. After Smith was pepper sprayed, he took the umbrella and started breaking out the windows in the residence.
Officers on the scene attempted to speak with Smith about the incident but he began to argue about the legality of the victim using pepper spray. Smith who was yelling at the officers took a swing at one of the officers. Smith struck the officer in the face and later kicked the officer in the chest. During a struggle, Smith resisted the officers but was eventually placed under arrest.
Smith who was seen by the Cumberland City Fire Department at the scene was transported to the Western Maryland Regional Medical Center. The officer who was assaulted was also treated and later released from the Western Maryland Regional Medical Center. Smith was taken into custody after he was released from the hospital. Smith was served and taken before the District Court Commissioner. Smith was held in the Allegany County Detention Center on $8,000.

Charges: Assault on Police, 2nd Degree Assault, Resisting Arrest, Malicious Destruction of Property and Disorderly Conduct.
