With no signs of closure with CSX Transportation concerning the failing West Side bridges- the city of Cumberland early this year retained the “advice and counsel” of the Kaplan, Kirsch and Rockwell law firm, which has offices in New York City, Denver and Washington, D.C. The firm has expertise in transportation and land use law. Two of the bridges have already closed having failed inspection- and to date CSX is refusing even to acknowledge ownership of the aging structures. Later today the Mayor and City Council will meet in closed session for the purpose of receiving legal advice on the bridge issues. Michael Cohen, city attorney, is on record as saying that retaining the services of the law firm does not necessarily mean the city will sue CSX to force the transportation giant to finance the rebuilding of the bridges. In fact, he says going to court is the least desirable alternative at this point…
