CDS ARREST, BENCH WARRANT & CRIMINAL SUMMONS SERVED

On Thursday, May 16, 2024, officers of the Cumberland Police Department responded to the area of Park Street and S. Central Avenue for a suspicious subject who was later identified as Brian Simmons Jr.  It was reported to the police that Simmons was in possession of a firearm.  Officers located Simmons in the 700 block of Maryland Avenue at which time he fled on foot.  Officers then engaged in a short foot pursuit.  They were able to catch up to Simmons in the 500 block of Maryland Avenue and place him in hand restraints.  It was learned that Simmons had an active Circuit Court bench warrant.  The warrant was issued as the result of Simmons violating the conditions of his probation.  He was originally charged with CDS: Possession with the Intent to Distribute Narcotics.  He was arrested and searched.   Simmons was found to be in possession of suspected controlled dangerous substance paraphernalia.  He was issued a criminal citation for possession of CDS paraphernalia and transported to police headquarters.  Simmons was also served with a criminal summons. The summons was issued as the result of an incident that occurred on May 1, 2024.  On this date at approximately 5:08 PM, police responded to a residence in the first block of E. Offutt Street for a breaking and entering complaint. Police located the suspects inside the residence.  Simmons was one of the suspects identified.  Simmons was found to be in possession of controlled drug paraphernalia and suspected fentanyl.  Police filed for charges against Simmons and he signed for his copy of the summons.  Simmons was then transported to the Allegany County Detention Center where he is currently being held without bond pending his appearance before the court.
